Privacy Policy

1.    General

1.1          The Dr.  Silvia Ling's clinic and drsilvialing.com (The Website) has recognized and has respected the importance of protecting the privacy and the rights of any individuals and parties (companies or organizations) who use The Website for own self or as a representative for another individual or parties or the individual or parties for who may have others to act on behalf or to represent, registered or non-registered (The Users’/’The User’), in relations to their personal information or non-personal information.

1.2          The privacy policy of The Website is governed by Australian Privacy Principles (The Privacy Principles), which are set out in The Privacy Act (1988), the Privacy Amendment (Private Sector) Act 2000 ,and N.S.W. specific privacy laws. The Website is committed to take all possible measures to use and protect the privacy of information and in comply according to the privacy policies (The Privacy Policy) set out hereof .

1.3          The Privacy Policy covers areas including the collection, usage, management, disclosure, security, access, inquiry of personal information and amendments policy of The Website. The Privacy Policy covers all people who use the services and products of The Website or otherwise provide personal information to The Website.

1.4          The Website may contain links operated by other third parties for the ease and convenience of The Users. The Website do not represent, provide no warranties, or in control of or take any responsibility in relations to the operations, the content or the privacy practices of any third party websites or organizations. The Users should take on own caution and look into the details of the third party websites.

2.             Definition of Private Information / Personal Information

2.1          Personal information which The Privacy Policy refers to, including any information which can personally identify The User,  including but not limited to the full or the partial of the name, address, telephone number, email address, profession or occupation, referral information, medical and treatment history and information, request, copies of any letters of referrals and copies of any reports back and any additional information relating to The Users that The Users provide to The Website directly through our representatives, web pages, medical or associate health professionals providing services at or from The Website, or otherwise, whether the information is considered as sensitive or otherwise according to The Privacy Principles.

2.2          Non – personal information which The Privacy Policy refers to, including any information which can not by itself personally identify The User, including but not limited to anonymous answers to surveys or aggregated activities records information when using The Website.

3.             Collection of Information

3.1          The Website collect, hold, use and disclose personal or non personal information about The Users, so that The Website can perform the medical or related services and treatment, business, administrative, billing, quality assurance and improvement activities, updating of relevant information or records, requested services, follow up services, activities and functions and to provide the best possible quality of services to The Users and to perform researches and analysis by The Website or other associated medical specialist, consultant or professionals or clinic or medical center and to comply with any law, rule, regulation, lawful and binding determination, decision or direction of a regulator, or in co-operation with any governmental authority of any country and to meet obligations of notification to our medical defense organizations or insurers. When the required personal or non personal information of The Users can not be collected in full or in partial, some of all the above activities or services may not be fulfilled or not be provided in the desired level of qualities or standards or accuracy.  

3.2          In the case when it is reasonable, lawful, fair and practical to do so, The Website may collect the personal or non-personal information from The Users in many ways, including but not limited to the direct input or submission of The Users or the User’s Representatives, authorized disclosure by The User’s other medical professionals or centers or third parties or as required by law enforcement or government entities to and from whom The Users may or may not have referred, electronic or automatic tracking or recording of activities (such as computer electronic cookie files) of The Users at the Websites. The Websites will take reasonable steps to maintain that the information that collected, used and disclosed is accurate, complete and up to date, as in the above mentioned ways.

4.             Disclosing of Information

4.1          The Website chooses very carefully to whom The User’s Information may be disclosed to and who may have access to The User’s information or records. At The User’s request or The consents of The User’s in writing, The Website shall disclose the information held in full or in partial to the particular person or organizations.

4.2          Without written consents by The User’s, The User’s Information may be disclosed to or accessed by The Website’s employees, medical professionals and associated health practitioners who provide medical services to The Users at requested, associated bodies or corporate, contractors or service providers for the purposes of operation of The Website’s business or services, activities to fulfill requests by The Users, law enforcements or government bodies as required by the Laws of Australia or N.S.W. and to otherwise provide products and services to The Users including but not limited to web hosting providers, IT systems administrators and staff, mailing  or delivery services organizations, payment processors, data entry service providers, electronic network administrators, debt collectors, and professional advisors such as accountants, solicitors, business advisors, associates, and consultants, The User’s pre-authorized representative or representative with The User’s expressed consent, health professional from whom The User referred to. The Website may also share or combine information of The Users collected by The Website with information collected by other Associated organizations.

4.3          In the case when The Users are from an overseas country, The Websites may disclose personal information to the relative organizations or bodies in overseas similar to the above mentioned parties.  Otherwise, unless The Websites has obtained the written consent from The Users, The Websites will not share or disclose personal information of The Users with overseas organizations or bodies.

4.4          Your personal information will not be shared, sold, rented or disclosed other than as described in The Privacy Policy or as permitted under The Privacy Principles.

5.    Security

5.1          The Website may hold or retain the personal or non-personal information of The Users in either electronic or hard copy format. The Website has taken reasonable steps, including physical, electronic and managerial procedures, to ensure personal information of The Users is protected from misuse and loss, unauthorized access, modification or disclosure. Personal Information of The Users would be destroyed or de-identified when no longer in need or after a certain period of time.

5.2          However, as majority of The Website is linked to the internet, which is inherently insecure, especially in the transmission of information The Users communicate with The Websites online. The Website cannot provide assurance or guarantee that such communicate may not be intercepted during transmission over the internet. Therefore personal information or non-personal information transmitted to The Websites over the internet are sent to The Website at the own risk of The Users.

6.    Access and control to personal information

6.1          The Users may request access to the personal information The Website has collected from The Users at any time by contacting The Website in writing by mails or by emails. While The Website will try to provide suitable means of accessing, The Websites may charge The User a reasonable fee to cover administrative costs or other costs in providing such access. If The Users need to make a correction or to fill the missing parts to The Website’s personal information, The Users may send the request and the ground for amendment. The Websites will make reasonable considerations to process the request.

6.2          There may be situations that The Websites may deny The User access to the full or partial of the Website’s personal information record of The User’s own self, including but not limited to the cases that such access may interfere with the privacy of others, or result in a breach of confidentiality.

6.3          The Users may choose to restrict the use of The User’s own personal information by sending the request to The Website in writing by mail or email. The Website will then only disclose such information at the permission of The Users or only as required by The Laws of Australia or N.S.W.

7.   Inquiries about Privacy

7.1          The User may contact us by writing in mail or email when The Users have believed that The Websites has breached The User’s own privacy in accordance to The Privacy Policy or The Privacy Principles. The Website will process investigation and deal with such complaint immediately.

7.2          The Users shall write to The Websites by mail or email for any complaint, concerns, inquiry or request about The Privacy Policy. The Website representative will contact you within a reasonable time after receiving the writing and The Website will treat such writing in confidence.

8.    Amendment to Privacy Policy

8.1          The Website may review and change or make amendments to The Privacy Policy from time to time by updating the posting on this web page and will not make specific notifications to The Users. The Users should check this web page from time to time to ensure that The Users are happy with any changes.

Terms and conditions of Use

1.    Acceptance  of Terms and Conditions

1.1          The use of Dr Silvia Ling's Clinic / drsilvialing.com  (The Website) constitutes an agreement to be bound by all the terms and conditions herewithin. This Agreement is governed by the laws of the New South Wales and Laws of Australia.

1.2          The Website is for the use by persons who are 18 years and over only, unless otherwise accepted or explicitly indicated. The following Terms and Conditions of Use Agreement (the "Agreement") contains the terms and conditions of use applicable to any and all users, including any individuals and parties (companies or organizations) who use The Website for own self or as a representative for another individual or parties or the individual or parties for who may have others to act on behalf or to represent, registered or non-registered (The Users’/’The User’), including but not limited to receiving medical advises, receiving medical consultations from the Medical doctors or professionals or the Associate Medical doctors or professionals of The Websites, or accessing The Website for whatsoever purpose, booking appointments, requesting referrals, using the information, texts, images, graphics, videos and/or audio material, software, files, directories, listings and databases contained in The Website, products and/or services provided by or through The Website, promoting business between The Users of The Website at home country or abroad (The Services). The Websites may send or serve any notice or document to The Users’ email address. If the notice or document arrives at The Users’ email system, as last updated by The Users (or the circumstances justify the assumption that the service has been made), the service shall be deemed completed. By using The Website, without limitation or qualification of any kind, you acknowledge and accept the terms and conditions hereof and agree that you will be bound by and to comply with the terms and conditions contained in this Agreement and any other legal notices, regulations, posted guidelines or rules applicable to The Services. 2.1          The Users indemnify The Website, its medical doctors, associate medical or specialist consultants, medical specialists, professional specialists, affiliates, employees, agents, officers, directors, officers, owners, co-branders, subsidiaries, agents and contributors, third party content providers, hyperlinked websites, and licensors (The Website Associates) from and against all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred or suffered by The users or by The Website as a direct or indirect consequence of The Users accessing, using The Service on The Website or on any other locations of The Website Associates or The Users’ attempts to do so and any breach by The Users or The Users’ agents of these Terms and Conditions.

2.2          The information and The Services on The Website is provided in good faith, however, without warranties whatsoever to its accuracy or completeness or updated. Any information, including but not limited to all medical information (if any), contact and information of medical specialists (if any), blogs (if any), provided in The Website may not be current, please verify the information in other ways to confirm it is current at own efforts. All submission of requests to The Website does not automatically guarantee results or confirmations on the requests, including but not limited to a guarantee of appointment booking, acceptance of referral request or reply, in particular by The Website Associates. The User should make other means to verify the submissions and confirmations at own efforts. However, if The Users wish to obtain The Services from The Website, The Users should not rely solely on The Services in The Website but should make specific enquiry concerning the nature of The Services and their suitability for the use to which they will be put.

2.3          The Website Content is not intended to and does not constitute medical opinion or professional advice or any advice or guarantee of any other kind on any particular matter. The accuracy, completeness, adequacy of the Content is not warranted or guaranteed. The Web Content provided on The Website is intended to help The User make better healthcare decisions and take greater responsibility for The User’s own health. Information obtained by using The Website is informational and not exhaustive. The Website does not recommend the self-management of health issues. The Website will not be responsible for cancellation or rescheduling or errors of appointments of omission of request. The Users will be solely responsible for any personal effects or the effects on the representing individual, damages to The Users’ computer system or loss of data that result from the use of The Website or the download of any material and/or data from The Website. The Website / The Website Associates shall not be responsible for any content found on The Website. All request or appointment booking or request for referral submitted to The Website does not guarantee a confirmation of booking or acceptance of referral. The Website will not be responsible for cancellation of appointments of omission of request, including but not limited to the medical consultants or professional consultants of The Websites and The Websites Association at The Websites locations or any related locations.

2.5          The Website / The Website Associates expressly hereby disclaims, to the fullest extent permitted by law, all warranties of any kind whatsoever, conditions or other terms as to the quality of The Services or their suitability for any particular purpose, whether expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. The Website / The Website Associates make no warranty that The Website will be uninterrupted, timely, securely or error free.

2.6          The Website / The Website Associates is not liable for interruption to The Services directly or indirectly as a result of nature causing, hardware malfunction, software related problems, telecommunications, electrical failures, strikes, labor disputes, riots, wars, governmental actions, human errors or other obstacles. The services available to you on The Website may contain errors and The Services are subject to periods of interruption.

4.4          All request or appointment booking or request for referral submitted to The Website are restricted to as a request at goodwill, not a contractual agreement, and are subjected to further confirmations by The Website or The Website Associates.

4.5          All links to third party websites are included or designed for the convenience of The User to provide further information or direct to subject or information that The User may find interested. These links do not imply or signify any endorsement or association to any third party websites. The Website does not have any responsibility for the content of the linked third party websites. The User may not create any link to The Website from any other third party website or document without any written consent by The Website.

4.6          The Website prohibits any unlawful use of The Website and The Website Contents. The Websites reserves all rights to investigate reports and complaints in violations of effective laws and terms and conditions herewithin and to take any action deemed appropriate including but not limited to forwarding any suspected activities to law enforcement or any appropriate parties and taking legal actions and disclosing any information necessary or appropriate to such parties, including but not limited to The User profiles, personal information, usage history, submission information, IP address and traffic information.

4.7          The Website reserves all rights to terminate the usage of The Website to any user or individual or organization or block access to The Website or part of The Website from any particular internet address at any time without any need to give any reason, whatsoever.

5.    Review and Amendments to This Agreement

5.1          The Websites and The Website Associates reserve the right to review, amend, update and modify any of the Terms of Use or any part of The Agreement at from time to time in its sole discretion, without any prior notice to The Users. Changed terms and conditions/ The Agreement will become valid upon being posted on The Websites. This page should be reviewed periodically so that The Users are updated on any changes. The Users have the obligations to check the Website from time to time in order to determine if such amendments have been made. The continuous use of The Services by The Users signifies The User’s acceptance of the changed Agreement. The Websites and The Website Associates welcome the comments and feedback of The Users.
